Pursuant to Article 88 of the Constitution of the Republic of Croatia, I hereby pass the

DECISION

PROMULGATING THE ACT ON AMENDMENTS TO THE DEPOSIT INSURANCE ACT

I hereby promulgate Act on Amendments to the Deposit Insurance Act, enacted by the Croatian Parliament at its session on 11 December 2009

ACT

ON AMENDMENTS TO THE DEPOSIT INSURANCE ACT

Article 1

In the Deposit Insurance Act (“Official Gazette” of the Republic of Croatia No. 177/04 and 119/08), Article 2, paragraph 3 shall be removed.

In paragraph 4, which shall become paragraph 3, the words "and 3" shall be removed.

Article 2

In Article 3, paragraph 3, words "previous paragraph" shall be replaced with "paragraph 2 of this Article.

Article 3

In Article 6, paragraph 1, the words: "21 days" shall be replaced with the words "5 working days" and words "credit institution and" shall be removed.

In paragraph 2, the words: "three months" shall be replaced with "20 working days" and the words "extend this time limit twice, each time for another three months" shall be replaced with "extend this time limit for another 10 working days".

In paragraph 6, behind the words: "the Agency" shall be added and read: "at latest".

In paragraph 7, the words "30 days" shall be replaced with the words "7 working days".

Article 4

Article 7 shall be removed.

Article 5

In Article 8, paragraph 6 shall be modified and read:

»(6) If a branch of a credit institution as referred to in paragraph (1) of this Article wishes to participate in the deposit-guarantee scheme under this Act, its participation begins upon the payment of the deposit-guarantee scheme admission fee as of paragraph 4 of this Article."

Article 6.

In Article 9, paragraph, 1 the word: "individuals" shall be replaced with "premium calculation" and the number: "0,10%" shall be replaced with "0,08%".

In paragraph 4, the words: "a bank, savings bank or building society" shall be replaced with the words: "credit institution".

Article 7.

In Article 17, paragraph 2, item 2, the words:"insurance premium payments" shall be replaced with "insured deposits".

Article 8.

In the heading above Article 18, the words: "to individuals" shall be removed.

TRANSITIONAL AND FINAL PROVISIONS

Article 9.

This Act shall be published in the “Official Gazette” of the Republic of Croatia, and become effective on 1 January, 2010. with the exception of the provisions laid down in Articles 3 and 5 hereunder, which shall become effective on the date of the accession of the Republic of Croatia to the European Union.”
